I'm getting married March, 2011, and I met a band that I really want to book.?

However, the band's contract stipulates that the deposit is NON-REFUNDABLE. After a few negotiations with the band's leader, they are unwilling to budge on the non-refundable part of the contract. Is this customary? Should I be wary of booking the band?
